In accordance with the provisions of DL nº 24/2014, of February 14th and Law nº 94/96, of July 31st, this document establishes the terms and conditions to be observed when using the website www.ormada.pt, as well as in the process of purchasing the products sold there, made available to its users.

Therefore, users of the website must carefully read the conditions and privacy policy before using it, since by using it or placing an order, users are consenting to being bound by these conditions.

In case of disagreement with these conditions and privacy policy, users should not use the website www.ormada.pt.

These conditions may be changed, freely, and without prior notice, in order to adapt them to applicable legislation. As such, it is the responsibility of users to read the Privacy Policy and General Conditions periodically, as the provisions in force on the date of use of the website and the conclusion of the contract (as defined herein) will apply.

These general terms and conditions of sale are agreed between Ormada Têxteis e Imóveis Unipessoal, Lda., with registered office at Rua da Cabreira, 286B, Apartado 3006 EC Pevidém, 4835-310 Guimarães, with NIPC 510323570, and any user who wishes to place an order through the website www.ormada.pt.

1º Availability of samples

The requested samples will be sent in the colors and sizes available at the time of the request. It is not possible to choose a specific color or size.

2º Order Evaluation

All sample requests are subject to evaluation by Ormada’s sales team.

3º Costs

After the order has been evaluated, the customer will be informed of any costs associated with the sample, including shipping.

4º Shipping Confirmation

The sample will only be sent after confirmation by the customer and payment of any costs, if applicable.

5º Limitations

Ormada reserves the right to refuse requests for samples or limit the quantity requested, in accordance with its internal policy.

6º Return Policy

Samples sent are not subject to return.

7º Delivery Deadline

Delivery times may vary depending on availability and destination, and will be communicated to the customer after order confirmation.

8º Right of free resolution

The user has the right to freely terminate this contract within 14 calendar days, without needing to indicate any reason.

The period for exercising the right of free resolution expires 14 days from the day following the day on which the contract was concluded.

In order to exercise your right to free resolution, the user must communicate to us at Ormada Têxteis e Imóveis Unipessoal, Lda., Rua da Cabreira, 286B, Apartado 3006 EC Pevidém, 4835-310 Guimarães, or by telephone +351 911 988 777 (Call to the national mobile network) or by email to info@ormada.pt your decision to terminate the contract by means of an unequivocal declaration by registered letter sent by post or email.

For the free resolution period to be respected, it is sufficient that the communication regarding the exercise of the right of free resolution is sent before the end of the resolution period.

9º Effects of free resolution

In the event of termination of this contract, all payments made by the user will be reimbursed to the user, including delivery costs (with the exception of additional costs resulting from the choice of a shipping method other than the least expensive standard shipping method offered by us), without undue delay and, in any case, no later than 14 days from the date on which we are informed of your decision to terminate this contract. Refunds will be made using the same payment method used in the initial transaction, unless expressly agreed otherwise by the user; in any case, the user will not incur any costs as a consequence of such refund.

Refunds may be withheld until we have received the returned goods, or until you have provided proof of having sent the goods, whichever is the earliest.

In situations where the contract involves the delivery of goods to users:

In case of termination of the contract, the user must return the good(s) to Ormada Têxteis e Imóveis Unipessoal, Lda. without undue delay and no later than 14 days from the day on which the user informs us of the free termination of the contract. The deadline is considered to have been respected if the user returns the goods before the end of the 14-day period.

The costs of returning the goods will be borne by you.

The user is only responsible for the depreciation of the goods resulting from handling that exceeds what is necessary to verify the nature, characteristics and functioning of the goods.

10º Responsibility

1º For all stages of access to the www.ormada.pt page, as well as the ordering process, delivery and subsequent services, Ormada Têxteis e Imóveis Unipessoal, Lda. only has an obligation of means.

2º Ormada Têxteis e Imóveis Unipessoal, Lda. does not guarantee nor is it responsible for any inconvenience or damage inherent to the use of the internet network, service interruption, external invasion or presence of computer viruses, or any other case of force majeure.

3º The products will be described and presented on the website www.ormada.pt as accurately as possible. If, even so, errors occur on the website www.ormada.pt, Ormada Têxteis e Imóveis Unipessoal, Lda. is not responsible for such fact.

4º The provisions herein do not affect the rights granted to users, relating to the withdrawal of the contract.

11º Processing of personal data

1º The information or data provided by users will be treated in accordance with the provisions of the Privacy Policy.

2º By using the website www.ormada.pt, the user consents to the processing of the information and data referred to in the preceding number and declares that all the information provided is true and corresponds to reality.

3º Personal data will be used by Ormada Têxteis e Imóveis Unipessoal, Lda. for information, dissemination and order processing actions.

4º The user is guaranteed the right to access, rectify, change or delete their personal data, simply by sending an email to info@ormada.pt.

5º Notwithstanding the fact that Ormada Têxteis e Imóveis Unipessoal, Lda. collects and processes data securely and prevents loss or manipulation, using the most advanced techniques for this purpose, we inform you that collection on an open network allows the circulation of personal data without security conditions, running the risk of being viewed and used by unauthorized third parties.

12º Viruses, hacking and other computer attacks

Ormada Têxteis e Imóveis Unipessoal, Lda. is not responsible for any damages or losses resulting from a denial of service attack, viruses or any other technologically harmful or damaging program or material that may affect the user’s computer, computer equipment, electronics, data or materials, as a result of the use of the website www.ormada.pt, or the downloading of content from it or the content to which it redirects.

13º Intellectual Property

1º All elements, whether sound or visual, of the website www.ormada.pt, including the underlying technology, are protected by copyright, trademarks or patents.

2º The user who has a personal website and who wishes to place, for personal use, on his/her website a simple direct link to the page www.ormada.pt, must request prior authorization from the company Ormada Têxteis e Imóveis Unipessoal, Lda.. The authorization is only valid if given in writing.

3º Any link or hypertext directed to the website www.ormada.pt, using framing or in-line linking techniques is formally prohibited.

4º In all cases, the use of any link, including those referred to in 2nd and 3rd of this article, even if authorized, must be removed upon simple request from the company Ormada Têxteis e Imóveis Unipessoal, Ltda.

14º Total agreement

These general terms and conditions of sale constitute the entire agreement between Ormada Têxteis e Imóveis Unipessoal, Lda. Should any of the clauses of these terms and conditions become null or void due to a change in legislation, regulations or a sentence, it shall be deemed to be unwritten.

15º Unilateral amendment of these conditions

1º These conditions may be changed at any time. The user is subject to the policies and conditions in force at the time he/she is using the website www.ormada.pt or formalizes his/her order, unless, by law or decision of government bodies, changes are made, with retroactive effect.

2º In the case provided for in the second part of the previous paragraph, the changes will also affect requests that the user has formalized under the conditions subject to change.

16º Applicable legislation and jurisdiction

Portuguese law applies to these conditions. Any dispute arising from these conditions will be submitted to the competent Portuguese court.

17º Alternative Dispute Resolution

In the event of a consumer dispute, the consumer may resort to a Consumer Dispute Resolution Entity.
